Setting up in business

Legal advice is essential whether you are intending to set up a business to trade on your own, in partnership with others or through a Company or buy an existing business:

  • Constitution - if you are going into business with other parties you will need a Partnership Agreement or, in the case of a Company, an Agreement with your co-shareholders
  • Finance – you will need to know about the sources of finance available and the legal implications of borrowing. If security is needed, should you mortgage the family home?
  • Business premises – will there be a Lease? What rights and obligations will you have? Can the Landlord increase the rent? What happens when the Lease expires?
  • Employment – this is an exceptionally broad and constantly changing area of the law touching upon employees rights, Health and Safety, discrimination in all its forms, etc
  • Insurance – your business will expose you to many varied risks including, for example, risks and potential liabilities associated with the occupation of your business premises, employment of staff, visitors and public liability, etc.
