Clients often need advice and legal action taking with regard to many different and varied situations, for example:
Title and boundaries
The system of Land Registration we have is designed to avoid disputes about property and land ownership. But, our part of the country is one of the last areas to have had compulsory registration introduced and it will be a very long time until even most of the properties are registered. Even then, experience shows, that there is still a good deal of scope for disagreement and dispute about Title to land.
Disputes range from identifying areas of ownership to rights over land. Fortunately, negotiation usually resolves matters but where this is not possible it might be necessary either to have an Adjudication of the issues by the Land Registry or proceedings in Court.
Consumer law
Consumer Protection legislation provides rights for consumers who purchase or acquire goods or services enforceable, if necessary, through the Courts.
Personal injury
The law relating to claims for compensation for personal injury is a wide area of the law touching many areas of day to day life, road accidents, trip cases, accidents at work and so on. Usually there is an Insurance company involved.
There are prescribed legal procedures enabling legal disputes of this kind to be resolved by negotiation or, if this is not possible, through the Courts.
Family and matrimonial
Unfortunately and inevitably some marriages do break down and when this happens each party will need independent legal advice concerning the relationship breakdown, the possibility of divorce proceedings, financial, capital and income settlements. Sadly advice will also be necessary about the law relating children and in the case of instances of those suffering domestic violence.
Insolvency and bankruptcy
Insolvency and bankruptcy law governs the position of businesses and individuals who are in financial difficulties and cannot meet their outstanding commitments.
It involves the parties meeting with a trained independent person (the mediator) to explore whether a mutually acceptable solution can be found to the dispute.
